Remote Online Notarization for Attorneys: When Your Client Can't Be in the Room

Your documents are ready.

Your client isn't.

Maybe they're traveling. Maybe they've relocated. Maybe one spouse is in Florida and the other is in New York. Maybe your client is sitting in London while a transaction in the United States needs to move forward.

Traditionally, that meant finding another notary, coordinating an office visit or delaying execution.

Remote Online Notarization can offer another option.

Florida law allows a commissioned Florida online notary who is physically located in Florida to perform an online notarization even when the signer is located somewhere else.

For attorneys, that can turn a geographic problem into a scheduling problem—and scheduling problems are considerably easier to solve.

What is Remote Online Notarization?

Remote Online Notarization allows a commissioned online notary and signer to complete a notarial act using approved live audio-video communication technology.

Florida's RON framework includes requirements involving identification, credential analysis, identity proofing, electronic records and recording of the audio-video session.

It isn't simply a Zoom call with a notary.

The technology and process are designed specifically for electronic notarization.

When can RON be useful to a law firm?

Some of the most useful RON assignments aren't particularly dramatic.

They're simply inconvenient.

A client can't leave work.

A former Florida resident has moved.

A transaction has several signers in different states.

Someone is traveling internationally.

An attorney needs a document executed today and the client is nowhere near the office.

A private client doesn't want another appointment added to an already packed calendar.

RON can provide attorneys with another execution option when location—not the substance of the legal matter—is creating the obstacle.

Can my client be outside Florida?

Yes.

Florida law permits an online notary physically located in Florida to perform an online notarization regardless of whether the principal or witnesses are physically located in Florida.

When a principal is outside Florida, Florida law also requires confirmation that the principal wants the notarial act performed by a Florida notary under Florida's general law.

That makes RON useful for firms with clients who travel frequently, own property in multiple states or spend substantial time outside Florida.

What about clients outside the United States?

International signers can sometimes complete Florida RON as well.

However, international assignments deserve additional preparation.

Identification and identity-proofing requirements still apply, and the technology used must be capable of successfully verifying the signer.

For that reason, I prefer to identify potential international-signing issues before the appointment rather than during it.

When referring an international client, providing the following upfront is extremely helpful:

Country where the signer will be located
Type of identification available
Number of signers
Number and location of witnesses
Document type
Signing deadline
Whether the completed document will be used domestically or internationally

Those details can save a remarkable amount of back-and-forth.

Can witnesses participate remotely?

In qualifying circumstances, yes.

Florida law permits an online notary to supervise the witnessing of certain electronic records. A witness may be physically present with the principal or participate through audio-video communication technology, subject to applicable requirements.

But attorneys should determine how they want their documents executed and communicate those instructions before the signing.

I don't interpret an attorney's document and decide whether it needs one witness, two witnesses, no witnesses or a particular notarial act.

I execute the notarization according to the lawful instructions provided.

For law firms, that's an important distinction.

What happens when several clients need to sign?

This is where having a notary who regularly handles remote transactions becomes especially useful.

Multi-party execution can involve:

Different states
Different countries
Different time zones
Multiple witnesses
Separate signing sessions
Different identification challenges
Last-minute scheduling changes

A clean process starts with mapping the transaction before invitations are sent.

Who is signing?

Where is everyone?

Who needs to witness?

Who needs to receive the completed documents?

What's the actual deadline?

It sounds simple.

It also prevents most of the chaos.

What types of attorney matters may involve notarized documents?

Depending on the matter and the attorney's instructions, RON may be considered for documents connected with areas such as:

Real estate transactions
Estate planning
Affidavits and sworn statements
Business and corporate matters
Powers of attorney
Trust-related documents
Property matters
International transactions
Other documents requiring acknowledgment or oath

Not every document is appropriate for RON, and document-specific laws or receiving-party requirements may apply.

The attorney remains responsible for determining the appropriate legal document, execution method and notarial act.

Why use a dedicated RON professional instead of simply finding any available online notary?

Because complicated signings rarely become complicated because someone doesn't know where to place a signature.

They become complicated because people, technology, deadlines and instructions don't line up.

An experienced RON professional can help manage the execution side of the transaction:

Signer coordination
Platform logistics
Identity-verification preparation
Multiple sessions
Witness coordination when appropriate
International signer logistics
Time-zone coordination
Communication before and after execution

For a law firm, the objective isn't merely obtaining a notarization.

It's getting the document executed correctly without the attorney or staff having to babysit the process.

That's the service I want DM Notary Solutions to provide.

A better client experience

There's another benefit that doesn't appear on the notarial certificate:

client experience.

Your client may be signing something extremely important to them.

They shouldn't have to figure out RON technology alone, hunt for a notary while traveling, or exchange twelve emails simply to schedule a signature.

The best execution experience is often the one the attorney barely has to think about.

Send the documents.

Introduce the client.

Let me handle the signing logistics.

Attorney FAQ

Can a Florida Remote Online Notary notarize for my client in another state?

Yes. A Florida online notary physically located in Florida may perform an online notarization when the principal is located outside Florida, provided Florida's RON requirements are satisfied.

Can my client use a Florida online notary while overseas?

Potentially, yes. Florida law does not require the principal to be physically located in Florida, although identity verification, technology, document requirements and acceptance should be considered.

Can witnesses participate remotely?

Florida law allows remote witnessing of certain electronic records subject to statutory requirements. Some documents have additional execution requirements.

Can you handle several signers in different locations?

Depending on the transaction and document requirements, yes. Multi-party RON sessions can be coordinated across locations and time zones.

Does my firm need its own RON platform?

Not necessarily. Florida law provides that the online notary selects the RON service provider, subject to an exception involving certain contractual or employment arrangements.

Can our firm refer clients directly to DM Notary Solutions?

Yes. Law firms can refer the signer and provide the relevant signing instructions so the execution logistics can be coordinated directly with the client.
